Group Leader Terms & Conditions

By registering as a Group Leader with Experiana Trails, you enter into a binding agreement governed by the Indian Contract Act, 1872 and Consumer Protection Act, 2019. Please read these terms before proceeding with Group Leader registration.

1. Introduction

These Group Leader Terms & Conditions ("Terms") constitute a legally binding agreement between Experiana Trails Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office in Jaipur, Rajasthan (hereinafter referred to as "Experiana Trails", "Company", "We", "Us" or "Our") and any individual enrolling in or participating in the Experiana Trails Group Leader Program (hereinafter referred to as "Group Leader", "Leader", "You" or "Participant").

The Group Leader Program enables individuals to create and lead group travel experiences, curating itineraries and guiding travelers through memorable journeys while earning commissions on bookings.

By registering as a Group Leader, accessing the Leader Dashboard, creating experiences, or earning commissions, You confirm that You have read, understood, and agreed to be bound by these Terms.

2. Nature of the Group Leader Program

The Group Leader Program is a travel experience creation and leadership program.
   • Group Leaders are independent participants and not employees, agents, franchisees or partners of Experiana Trails.
   • Nothing in this agreement shall be construed as creating:
     - an employer-employee relationship,
     - a partnership,
     - a joint venture,
     - or a legal agency.
   • Group Leaders act independently and bear responsibility for the experiences they create and lead.

3. Eligibility

To participate as a Group Leader, you must meet the following criteria:
   • Be at least 21 years of age
   • Have a valid identity proof, address proof, and bank account
   • Possess relevant travel experience and leadership capabilities
   • Have knowledge of the destinations you intend to lead trips to
   • Agree to lead experiences ethically, safely and lawfully
   • Not be involved in fraudulent or misleading practices
   • Pass the verification process conducted by Experiana Trails

4. Group Leader Obligations

As a Group Leader, you agree to:
   • Create accurate and honest experience descriptions and itineraries.
   • Lead trips personally and be present throughout the experience duration.
   • Ensure traveler safety and well-being during the experience.
   • Communicate promptly with travelers regarding trip details and updates.
   • Avoid misleading, exaggerated, false, or deceptive claims about experiences.
   • Not impersonate Experiana Trails or claim to be a Company employee.
   • Handle emergencies responsibly and have contingency plans.
   • Maintain appropriate behavior and professionalism at all times.
   • Comply with all local laws, regulations and permit requirements.
   • Obtain necessary permissions and clearances for activities included in experiences.

5. Experience Creation & Approval

Group Leaders can create travel experiences through the Leader Dashboard.

All experiences are subject to review and approval by Experiana Trails before being published.

Experiana Trails reserves the right to:
   • Request modifications to experience details, itineraries or pricing,
   • Reject experiences that do not meet quality or safety standards,
   • Remove or unpublish experiences at any time for valid reasons.

Group Leaders must provide accurate information including:
   • Trip title, description and category,
   • Detailed day-wise itinerary,
   • Inclusions and exclusions,
   • Accurate photos representing the experience,
   • Start date and group size limits.

6. Commission Structure

Group Leaders earn a fixed commission of 10% on the total booking value of their experiences.

Commission is calculated on the base price paid by travelers, excluding:
   • Platform fees,
   • Payment gateway charges,
   • Applicable taxes.

The Company reserves the right to modify commission structures with prior notice.

7. Payments & Payouts

Commissions are payable ONLY after the trip is successfully completed.

No commission shall be payable for:
   • upcoming trips that have not yet occurred,
   • cancelled bookings,
   • refunded bookings,
   • no-show travelers,
   • trips cancelled due to Leader unavailability.

If a booking is cancelled or refunded for any reason, the corresponding commission shall stand cancelled.

Payouts are processed through withdrawal requests made by the Leader.

Earnings are first reflected in the Leader dashboard wallet before payout.

Group Leaders must ensure accurate bank details. The Company is not responsible for delays due to incorrect information.

Experiana Trails reserves the right to withhold, delay or reverse payouts in cases of:
   • suspected fraud,
   • policy violations,
   • chargebacks,
   • traveler complaints or disputes,
   • misuse of the program.

8. Traveler Safety & Responsibility

Group Leaders are responsible for:
   • Ensuring basic safety measures during the experience,
   • Having emergency contact numbers and medical facilities information,
   • Informing travelers about risks associated with activities,
   • Not forcing travelers into activities they are uncomfortable with,
   • Maintaining group cohesion and resolving conflicts.

Group Leaders must NOT:
   • Engage in activities that endanger traveler safety,
   • Consume alcohol or substances that impair judgment while leading,
   • Leave travelers stranded or abandon the group,
   • Engage in inappropriate behavior with travelers.

9. Cancellation by Group Leader

Group Leaders must honor all confirmed bookings.

If a Group Leader must cancel an experience:
   • Notify Experiana Trails immediately with valid reasons,
   • Provide at least 7 days advance notice when possible,
   • Assist in traveler communication and refund processing.

Repeated cancellations may result in:
   • Account suspension,
   • Reduced visibility of experiences,
   • Permanent removal from the program.

10. Prohibited Activities

Group Leaders shall NOT:
   • Create fake or misleading experiences.
   • Guarantee specific outcomes or experiences beyond reasonable control.
   • Use Experiana Trails branding without permission.
   • Collect payments directly from travelers outside the platform.
   • Create duplicate accounts or impersonate others.
   • Engage in activities that damage the Company's reputation.
   • Discriminate against travelers based on gender, religion, caste, or nationality.

Violation may lead to immediate termination and forfeiture of earnings.

11. Reviews & Ratings

Travelers may leave reviews and ratings after completing an experience.

Group Leaders should:
   • Accept feedback gracefully and constructively,
   • Not solicit or manipulate reviews,
   • Address valid complaints professionally.

Consistently poor reviews may result in account review or suspension.

12. Suspension & Termination

Experiana Trails reserves the right to:

Suspend or terminate a Group Leader account without prior notice if:
   • Terms are violated,
   • Fraud or abuse is detected,
   • Safety incidents occur due to Leader negligence,
   • Misrepresentation occurs,
   • Multiple traveler complaints are received.

Termination may result in:
   • loss of pending commissions,
   • cancellation of upcoming experiences,
   • permanent disqualification from the program.

13. Taxation

Group Leaders are solely responsible for:
   • income tax,
   • GST (if applicable),
   • any other statutory liabilities.

The Company may deduct TDS if required under Indian law.

14. Insurance & Indemnity

Group Leaders are encouraged to have appropriate personal liability insurance.

Group Leaders agree to indemnify and hold harmless Experiana Trails from any claims, damages, or liabilities arising from:
   • negligence in leading experiences,
   • accidents during experiences,
   • misrepresentation of experience details,
   • violation of local laws or regulations.

15. Intellectual Property

All trademarks, logos, platform content, and materials belong exclusively to Experiana Trails.

Group Leaders retain rights to their original experience descriptions and photos but grant Experiana Trails a license to use them for promotional purposes.

Unauthorized use of Company intellectual property is strictly prohibited.

16. Limitation of Liability

Experiana Trails shall not be liable for:
   • indirect or consequential losses,
   • loss of expected income,
   • incidents beyond platform control,
   • technical errors affecting bookings or tracking.

Total liability shall not exceed the commission actually earned by the Group Leader.

17. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Courts of Jaipur, Rajasthan shall have exclusive jurisdiction.

18. Amendments

Experiana Trails reserves the right to modify these Terms at any time. Continued participation after updates constitutes acceptance.
